| Spruce Pine Mayor Advocates Unconstitutional Ballot Access Restrictions |
BryanGreene2008 writes, "LENOIR, North Carolina (October 21, 2007) - During the past month, Bryan Greene and his campaign staff have come to find that the people of North Carolina’s 10th Congressional District are beginning to look for someone new to represent them in Congress. They are searching for a true conservative and constitutionalist and are now enthusiastically embracing Bryan Greene and his campaign of freedom and truly limited government for Congress.
On October 13, 2007, Bryan Greene and some of his campaign staff attended the Mineral City Heritage Festival in the beautiful town of Spruce Pine, NC. At the festival, Mr. Greene gathered signatures toward the 17,000 minimum (approx.) which are unconstitutionally mandated by NC General Statute §163-122(a)(2). These signatures are mandated in spite of the fact that the North Carolina State Constitution clearly reads in Article 1, Section 10 that “all elections shall be free.” These signatures simply show the state that the individual signer believes that Bryan Greene, just like any other candidate or individual, has the right and freedom to have his name printed on the election ballot and that the voters have the right to more than two choices."

Many have excitedly embraced the chance to extend to Bryan Greene his constitutional freedom to run for public office and to have his name printed on the ballot, although the state has wrongfully restricted him. Yet, unlike most individuals, such as the Spruce Pine candidate for Town Council who signed Mr. Greene’s petition, who support the right to the ballot as a basic freedom, there are those who refuse to support Bryan’s right to be on the ballot. The most notable of these very few individuals, is the mayor of Spruce Pine, Mr. Wes Foy, who refused to sign Mr. Greene’s petition.
In essence, Mr. Foy’s refusal to sign the petition tells his constituents and Mr. Greene’s campaign that he refuses to support the individual’s right to the ballot based on party affiliation (just as NCGS §163 discriminates against unaffiliated and third party candidates). His refusal also means that he denies the people of Spruce Pine their right to free speech, by supporting those unconstitutional ballot access laws that restrict the voters’ right to a third or even fourth choice on the election ballot. The mayor also mentioned that some part of his reasoning not to sign Mr. Greene’s petition is based simply on the fact that he is a friend of Bryan Greene’s opponent, Congressman Patrick McHenry (R-NC-10). Is this the type of person that the people of North Carolina’s 10th Congressional district want to represent them? One who values freedom for some conditionally, yet not for all citizens alike?
From a recent conversation with one of Congressman McHenry’s office staffers, Bryan's campaign manager was told that McHenry believes in free elections and that all candidates should be treated equally and without unrealistic or high restrictions on ballot access. Therefore, in the next few weeks Mr. Greene’s campaign will be testing the Congressman’s stance on free elections by asking him to sign Bryan Greene’s petition in support of his constitutional right to the ballot and the people’s right to a third choice. Congressman McHenry and the mayor of Spruce Pine should be willing to sign Mr. Greene’s petition if they truly embrace freedom for all. Otherwise, they are advocating the unconstitutional abridgement of the people of this great state’s right to free speech at the ballot (see article entitled “NC Election Law – Abridging Our 1st Amendment Rights @ http://www.bryangreene08.com/articles/nc_election_law.html).
Please help Bryan Greene by calling Congressman McHenry’s office and urging him to sign Mr. Greene’s petition if he values freedom for all.
